This Web Hosting Agreement is between Host Craze and the person/persons who use our website hosting and domain service. Please read carefully to ensure you understand our terms before purchasing any of our products or services.

Services

Host Craze agrees to provide the stated services at the agreed-upon price without any hidden costs. Unlike other web hosting providers, we maintain full transparency regarding pricing and features. Any promotional or discounted pricing will be honored only for the specified period, and renewal rates may differ.

Terms


All customers are responsible for monitoring their storage space and bandwidth usage on a monthly basis. If a customer exceeds their allocated limit, Host Craze will notify them via email with the option to either upgrade their plan or optimize their usage to remain within their current limits.

Customers who repeatedly exceed their usage limits may face temporary restrictions or service suspension if corrective action is not taken. While Host Craze will make every reasonable effort to assist in resolving overuse issues, we reserve the right to suspend or terminate accounts that persistently exceed resource limits, as excessive usage may negatively impact other users on shared services.
If a customer registers for an account and cancels within the first month, they will still be charged for the entire first month of service to cover administrative costs and resource allocation. Refunds or prorated credits are not available for partial months of service unless explicitly stated in a separate agreement.

Payments

Renewal notices are emailed three days before the actual renew date in your account. If you’re using a credit card you will not have to worry about manual payments. All accounts are set up on a pre-pay basis. If payment is not received within 7 days a $5 fee will be added. Host Craze reserves the right to change prices at any time, unless other terms have been agreed upon. Any account not brought current within a week (7 days) of e-mail notice or exceeding this time frame in any way is subject to suspension. YOU are responsible for all fees owed on the account from the time it was established to the time that YOU notify Host Craze to request for termination of services. Although we are based in the UK our websites currency is USD. YOUR particular billing cycle corresponds to the contract length that was initially chosen at setup. YOUR account will automatically renew at this length unless cancelled before hand. There is no fee for cancelled accounts that have been paid for yearly. If you cancel an account on the monthly billing cycle Host Craze can not refund any payments made before.
All annual payments are non refundable once the 30 day money back guarantee has passed. The only time your annual plan will end is if your account does not comply with our terms of service/acceptable usage policy. Both monthly and annual payments are non-refundable if your account does not follow our terms of service/acceptable usage policy.

Cancellation and Early Termination

By signing up for Host Craze services, customers acknowledge that service fees are pre-paid and non-refundable, except where explicitly stated. If an account is canceled before the end of its billing cycle, no prorated refunds will be issued, except where legally required.
Early termination of an annual plan within the first 30 days qualifies for a partial refund, excluding setup fees, domain registration fees, and any applicable administrative costs. Cancellation after 30 days will not be eligible for any refund.

Server Abuse

Any attempt to disrupt, modify, or interfere with server operations, including DDoS attacks, unauthorized server access, phishing, or exploiting software vulnerabilities, is strictly prohibited. Accounts found engaging in these activities will be immediately suspended and reported to law enforcement authorities if necessary.
Host Craze will strongly react to any use or attempted use of an Internet account or computer without the owner’s authorization. Such attempts include ‘Internet scamming’ (tricking other people into releasing their passwords), password theft, security hole scanning, etc.
Any unauthorized use of accounts or computers by YOU, whether or not the attacked account or computer belongs to Host Craze, will result in action against YOU. Possible actions include warnings, account suspension or cancelation, as well as civil or criminal legal action, depending on the seriousness of the attack.
IMPORTANT NOTE – Host Craze has the right to discontinue service, or deny access to anyone who violates our policies or the terms and conditions shown below WITHOUT WARNING or PRIOR NOTICE. No refunds of fees paid will be made if account termination is due to violation of the terms outlined below.
YOU may not run IRC, bots or clients on shared servers. Unacceptable uses also include, but are NOT limited to: Bulk emailing, unsolicited emailing, newsgroup spamming, upload scripts (Rappidleach), pornographic content, illegal content, copyright infringement, trademark infringement, warez sites (including links to/from), cracks, software serial numbers, proxy-relaying, link farming (the act of or by use of scripts), link grinding, link-only sites, spamdexing, FFA (Free-For-All) and/or anything else determined by Host Craze to be unacceptable use of our services including abuse of server resources.
WEB APPLICATIONS and WEB ACCESSIBLE SCRIPTS – All web applications that are out-of-date and actively being exploited will be shut down immediately without prior notice. YOU are responsible for and should evaluate YOUR web-based applications and scripts on a regular basis to ensure their security and orderliness.
Shared hosting accounts may also be terminated if it includes the following content or have links to the following content: Providing material that is grossly offensive to the Web community including blatant expressions of bigotry, racism, hatred, or profanity; promoting or providing instructional information about illegal activities; promoting physical harm or injury against any group or individual; displaying material containing obscene nudity or pornographic material (not applicable to managed dedicated servers); displaying material that exploits children under 18-years of age; acts of copyright infringement including offering pirated computer programs or links to such programs; information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities.

Disk Space Abuse

Host Craze will be the sole arbiter as to what constitutes a violation of this provision. You are responsible for monitoring your disk space usage. If you need extra disk space contact one of our staff and they will be happy to help out. You can also upgrade your hosting plan from inside your Host Craze client account.

Bandwidth Abuse

The intention of Host Craze is to provide a large bandwidth to transfer web documents, and not an offsite storage area for electronic files. If YOU violate this condition, YOU will be notified and given 48 hours to remedy the problem. Failure to do so will result in YOU being billed for the overages.
Traffic will go unmonitored until YOU reach the amount of quota allocated to YOUR specific PLAN. Host Craze will be the sole arbiter as to what constitutes a violation of this provision.

AUP

Customers agree to use our services under the Acceptable Usage Policy which is here by incorporated with this agreement. Customers agree that Host Craze hold the right to change their AUP at any time to meet web hosting standards and laws. Amendments to the AUP are effective on the earlier of Host Craze notice to Customer that an amendment has been made, or the first day of any Renewal Term that begins subsequent to the amendment. Customer agrees to cooperate with Host Craze reasonable investigation of any suspected violation of the AUP. In the event of a dispute between Host Craze and Customer regarding the interpretation of the AUP, Host Craze commercially reasonable interpretation of the AUP shall govern.

Customer Information

Customer represents and warrants to Host Craze that the information he, she or it has provided and will provide to Host Craze for purposes of establishing and maintaining the service is accurate. If Customer is an individual, Customer represents and warrants to Host Craze that he or she is at least 18 years of age. Host Craze may rely on the instructions of the person listed as the Primary Customer Contact on the Order with regard to Customer’s account until Customer has provided a written notice changing the Primary Customer Contract.

Unsolicited Email & Spamming


Host Craze strictly prohibits the transmission, distribution, or facilitation of unsolicited commercial email (SPAM) through its services. This includes bulk email campaigns, mass solicitations, or any form of electronic messaging sent without explicit recipient consent. Any violation of this policy may result in immediate account termination without refund, and in severe cases, legal action may be pursued.

The following activities are explicitly prohibited under this policy:
  • Sending bulk commercial advertisements, promotional emails, or mass mailing without the recipient’s prior consent.
  • Distributing informational announcements, charity requests, petitions, or political/religious messages without explicit opt-in consent from recipients.
  • Forging, altering, or removing electronic mail headers to disguise the origin of a message (stealth spamming).
  • Sending excessive duplicate or substantially similar emails with the intent to disrupt a recipient’s inbox or server operations (mail bombing).
  • Spamming Usenet newsgroups or public forums, including posting off-topic advertisements, commercial promotions, or irrelevant messages in multiple groups (newsgroup spamming).
  • Using Host Craze’s services to harass, intimidate, or threaten individuals through unwanted emails, excessive message frequency, or oversized email content.
  • Utilizing scripts, bots, or automation tools to send large volumes of unsolicited messages.
  • Sending messages to email lists obtained through scraping, purchased databases, or any third-party source that did not obtain explicit user consent.
Violations of this policy may result in immediate account termination without refund, along with any of the following actions:
  • Suspension or termination of hosting, email, or related services.
  • Permanent blacklisting of offending domains, email accounts, or IP addresses.
  • Reporting the violation to relevant authorities, including law enforcement agencies and anti-spam organizations.
  • Charging administrative fees for excessive resource consumption due to spam-related activities.
Customers may not use third-party services to promote websites hosted on Host Craze’s network via SPAM. If such activities are detected, Host Craze will treat the SPAM as originating from its own servers and may take enforcement action, including account suspension or termination.
All email communications sent through Host Craze’s services must comply with applicable anti-spam laws and regulations, including but not limited to the U.S. CAN-SPAM Act, the General Data Protection Regulation (GDPR), and any other jurisdictional email marketing laws. This includes the following requirements:
  • Providing a clear and accurate sender identity in all email headers.
  • Including a valid physical mailing address of the sender in commercial emails.
  • Providing a functioning opt-out mechanism that allows recipients to unsubscribe from future communications.
  • Honoring all unsubscribe requests within ten (10) business days.
Failure to comply with this policy may result in service suspension or termination, and in severe cases, legal liability under applicable anti-spam laws.

99.99% Uptime Guarantee

(1.) COVERAGE – This 99.99% Uptime Guarantee applies to any Customer in good financial standing with Host Craze at the time of a service outage.
(2.) SERVICE LEVEL AGREEMENT (SLA) & SPECIFICATIONS – Host Craze aims to ensure that YOUR website is accessible via HTTP by users worldwide 99.99% of the time. “Network downtime” (unavailability) is defined as 100% packet loss between Host Craze and its backbone providers. Downtime begins 10 minutes after a network failure is reported through Host Craze’s online ticketing system. If the ticketing system is unreachable, the outage must be reported by calling the Host Craze Network Operations Center (NOC).
Host Craze’s administrators will determine when downtime ends by running a traceroute to YOUR server from outside the Host Craze network.
(3a.) SHARED HOSTING CREDITS – If YOUR website’s uptime falls below 100%, Host Craze will apply the following credits toward the next month’s service fee. The credit is calculated based on the total hours in a calendar month, and cannot exceed 50% of the monthly service charge for the affected month:
  • 95% to 99.9% – YOUR account will be credited 10% of your monthly hosting fee
  • 90% to 94.9% – YOUR account will be credited 20% of your monthly hosting fee
  • 89.9% or below – YOUR account will be credited 50% of your monthly hosting fee (3b.)
Credits will not be issued for outages resulting from any of the following:
  • Scheduled maintenance announced by Host Craze
  • YOUR actions, or the performance/failure of YOUR equipment, facilities, or applications
  • Events outside Host Craze’s reasonable control, including (but not limited to) acts of governmental bodies, war, insurrection, sabotage, embargo, fire, flood, strikes, labor disturbances, transportation issues, telecommunication or third-party service interruptions/delays, DNS propagation, domain registration/transfer problems, third-party software/hardware failures, or the inability to obtain necessary materials/supplies/power for service provision
  • A breach of any policy within Host Craze’s Terms & Conditions or AUP by YOU that results in server failure

Technical Support Limits


Host Craze provides technical support services strictly within the scope of our hosting infrastructure and core server functionality. Our support team is available to assist with issues directly related to cPanel, hosting accounts, server configurations, and general hosting operations. However, there are limitations to the support services provided.

The following areas are covered under our technical support services:
  • Assistance with cPanel and control panel functionality.
  • Troubleshooting server-related issues, including connectivity and performance problems.
  • Diagnosis of server errors, logs, and basic security concerns.
  • Support for email configurations on our servers (excluding third-party email services).
  • Basic guidance on DNS settings, domain configurations, and SSL installations.
The following areas are outside the scope of our standard technical support services:
  • Installation, configuration, or troubleshooting of third-party applications, templates, or plugins.
  • Debugging custom scripts, PHP errors, or any issues resulting from customer-modified code.
  • Assistance with website design, development, or programming support.
  • Database troubleshooting beyond server-level database issues.
  • Configuring or debugging third-party email clients, such as Outlook, Thunderbird, or Gmail.
  • Restoration of customer data or backups beyond standard hosting restoration policies.
While Host Craze strives to assist customers whenever possible, we cannot guarantee support for issues unrelated to our hosting infrastructure. Customers are responsible for maintaining and troubleshooting their own website code, applications, and third-party services.
For assistance beyond the scope of our standard hosting support, customers may be referred to third-party web developers, software vendors, or specialized support services.

CGI SCRIPTS

Each shared web hosting account comes with its own CGI-BIN. YOU are free to use any CGI scripts YOU wish, however we reserve the rights to disable any CGI script that effects normal shared server operation without prior notice.

Indemnification

Customer agrees to indemnify and hold harmless Host Craze, Host Craze‘s affiliates, and each of their respective officers, directors, agents, and employees from and against any and all claims, demands, liabilities, obligations, losses, damages, penalties, fines, punitive damages, amounts in interest, expenses and disbursements of any kind and nature whatsoever (including reasonable attorneys fees) brought by a third party under any theory of legal liability arising out of or related to the actual or alleged use of Customer’s services in violation of applicable law or the AUP by Customer or any person using Customer’s log on information, regardless of whether such person has been authorized to use the services by Customer.
YOU AGREE TO DEFEND,INDEMNIFY AND HOLD HARMLESS Host Craze AGAINST LIABILITIES ARISING OF:
  • ANY INJURY TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS SOLD OR OTHERWISE DISTRIBUTED IN CONNECTION WITH Host Craze‘S SERVER.
  • ANY MATERIAL SUPPLIED BY THE CUSTOMER INFRINGING OR ALLEGEDLY INFRINGING ON THE PROPRIETARY RIGHTS OF A THIRD PARTY
  • COPYRIGHT INFRINGEMENT AND
  • ANY DEFECTIVE PRODUCTS SOLD TO CUSTOMER FROM Host Craze‘S SERVER.

Disclaimer of Warranties

Host Craze does not warrant or represent that the services will be uninterrupted, error free, or completely secure. To the extent permitted by applicable law Host Craze disclaims any and all warranties including the implied warranties or merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by applicable law all services are provided on an “As Is” basis.

Limitation of Liability


To the maximum extent permitted by applicable law, neither party shall be liable to the other for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings, arising out of or in connection with this Agreement, regardless of the cause of action, whether based on contract, tort (including negligence), strict liability, or any other legal or equitable theory, even if the affected party has been advised of the possibility of such damages.

In no event shall Host Craze, its affiliates, officers, directors, employees, agents, licensors, service providers, or suppliers be liable for any damages exceeding the total amount paid by the customer for the three (3) months immediately preceding the claim. This limitation applies regardless of whether damages arise from service interruptions, loss of data, security breaches, third-party claims, or any failure or delay in performance due to circumstances beyond Host Craze’s reasonable control, including but not limited to acts of God, natural disasters, strikes, cyberattacks, supply chain failures, utility failures, or government actions.
Nothing in this Agreement shall limit or exclude liability for gross negligence, willful misconduct, fraud, or any liability that cannot be excluded or limited under applicable law.

Suspension of Services/Termination


Customer acknowledges and agrees that Host Craze may suspend or terminate services at its sole discretion, with or without notice, and without liability under the following circumstances:

  • If Host Craze reasonably believes that the services are being used in violation of the Acceptable Use Policy (AUP), Terms of Service (TOS), or any applicable law.
  • If Customer fails to cooperate with any reasonable investigation of suspected violations of the AUP or TOS.
  • If Host Craze determines that suspension or termination is necessary to protect its network, infrastructure, employees, or other customers.
  • If a law enforcement or regulatory agency formally requests the suspension or termination of services.
  • If Customer engages in fraudulent activity, payment disputes (e.g., chargebacks), or other activities deemed harmful to Host Craze‘s business operations.
In cases of suspension, Host Craze may, at its sole discretion, impose a reasonable reinstatement fee before restoring services.
Termination by Customer
Customer may terminate this Agreement before the end of the Initial Term or any Renewal Term without liability if Host Craze materially fails to provide the agreed services and does not resolve the failure within ten (10) days of receiving written notice from the Customer detailing the issue. This notice must provide sufficient details regarding the alleged failure to comply with the Agreement.
Termination by Host Craze
Host Craze reserves the right to terminate this Agreement without prior notice and without liability under the following conditions:
  • If Customer is overdue on payment beyond five (5) days.
  • If Customer materially violates any provision of this Agreement, including the AUP, and fails to cure the violation within thirty (30) days of receiving a written notice.
  • If Customer repeatedly violates the AUP, TOS, or any service agreement, even after previous warnings.
  • If Customer provides false or misleading account information that impacts service administration.
  • If Customer becomes insolvent, files for bankruptcy, enters into receivership, assigns assets to creditors, or is otherwise unable to fulfill financial obligations.
Immediate Termination for Severe Violations
In extreme cases, such as an account being used for the distribution of child exploitation materials, hacking, phishing, fraudulent activities, or any illegal use, Host Craze reserves the right to immediately terminate services without prior notice. Accounts engaged in these activities will not be eligible for any refund, and where required, such activities will be reported to relevant authorities.

Refunds and Service Cancellations


Accounts terminated due to violations of the TOS or AUP are not eligible for refunds. This includes but is not limited to cases involving abuse, fraud, copyright infringement, or illegal activity.

For example, if a Customer’s hosting account is canceled due to a copyright violation within the first month of service, no refund will be issued for that month. This policy is in place to prevent abuse of our services for unlawful purposes.

Request for Customer Information


Customer acknowledges and agrees that Host Craze may, without prior notice, disclose Customer-related information under the following circumstances:

  • If required to do so by law, regulation, subpoena, court order, or other legally binding requests from governmental or regulatory authorities.
  • If Host Craze reasonably believes that such disclosure is necessary to comply with applicable laws or to respond to law enforcement investigations, subpoenas, or regulatory inquiries.
  • If Host Craze determines, at its sole discretion, that the Customer’s conduct, or the conduct of any of Customer’s end users, violates applicable laws, regulations, or this Agreement.
  • To enforce the Terms of Service (TOS) or Acceptable Use Policy (AUP), or to protect the rights, property, security, or safety of Host Craze, its customers, employees, or the public.
  • In response to a formal or informal request in a civil action, criminal investigation, or other legal proceeding, provided that such request, on its face, meets applicable legal requirements.
  • If necessary to prevent, detect, or mitigate fraud, security threats, intellectual property violations, or illegal activities associated with the use of Host Craze’s services.
Customer further agrees that Host Craze shall not be liable for any damages resulting from such disclosures, provided they are made in good faith and in accordance with applicable legal and regulatory requirements.
Host Craze reserves the right to comply with government-mandated data retention laws and to store customer data as required by jurisdictional regulations. Customers are responsible for reviewing their own legal obligations regarding the storage, transmission, and use of data while using Host Craze’s services.

Backup Copy


Customer acknowledges and agrees that maintaining up-to-date backups of all hosted content is solely the Customer’s responsibility, regardless of any backup services offered by Host Craze. While Host Craze may offer backup solutions, no guarantee is made regarding the completeness, availability, or reliability of such backups.

Host Craze shall not be liable for any data loss, corruption, or failure of backup mechanisms due to hardware failure, cyberattacks, unauthorized access, accidental deletions, or other unforeseen circumstances. Customers are strongly encouraged to implement independent backup solutions to ensure the integrity of their data.

Request for Restore of Hosting Package


Customers may request one (1) free restore per service term for any reason. Subsequent restore requests will be subject to a one-time fee of $10 per restore request.

Restore requests must be initiated by the authorized account holder and may take up to 48 hours to process, depending on server load and data volume. Host Craze does not guarantee the success of any restore request if the backup data has been lost, corrupted, or rendered unavailable for any reason.

Changes to Host Craze’s Network


Host Craze reserves the right to perform upgrades, modifications, and other changes to its network, infrastructure, software, hardware, and third-party service providers at any time to maintain or improve service quality, security, or performance.

These changes may impact the availability, functionality, or compatibility of Customer’s hosted content and applications. While Host Craze will make reasonable efforts to minimize service disruptions, it shall not be liable for any resulting harm, including but not limited to service interruptions, configuration conflicts, or required application updates due to such changes.
Customers are responsible for ensuring their software, website, and applications remain compatible with Host Craze’s evolving infrastructure. Host Craze is not responsible for issues arising from incompatibility with outdated software, plugins, or third-party dependencies.

Notices

Notices to Host Craze under the Agreement shall be given via electronic mail to the e-mail address posted for customer support. Notices to Customer shall be given via electronic mail to the individual listed as the Primary Customer Contact on the Order. Notices are deemed received on the day transmitted, or if that day is not a business day, on the first business day following the day delivered. Customer may change his, her or its notice address by a notice given in accordance with this Section.

Force Majored

Host Craze shall not be in default of any obligation under the Agreement if the failure to perform the obligation is due to any event beyond Host Craze‘s control, including, without limitation, significant failure of a portion of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labour action, terrorist activity, or other events of a magnitude or type for which precautions are not generally taken in the industry.

Governing/Law Disputes

This Agreement shall be governed by and interpreted under the laws of the State of Texas and the United States of America, without regard to conflict of law principles. Any disputes arising under this Agreement shall be exclusively resolved in the courts located in Texas.

Miscellaneous


Each party acknowledges and agrees that the other party retains exclusive ownership and rights to its trademarks, service marks, trade secrets, inventions, copyrights, and other intellectual property. Neither party may use the other party’s name, trademarks, or branding without prior written consent.

The relationship between the parties shall be that of independent contractors. Nothing in this Agreement shall be construed as creating a partnership, joint venture, agency relationship, or employer-employee relationship. Neither party shall have any authority to bind the other to any obligations or contracts, nor represent to any third party that it has such authority.
This Agreement may only be amended by a formal written agreement signed by both parties. Any terms included in a Customer’s purchase order, invoice, or other business document that are not expressly incorporated into a signed written agreement shall be considered void and unenforceable against Host Craze.
A failure or delay by either party in enforcing any provision of this Agreement shall not be considered a waiver of that party’s rights. A waiver of any provision shall not be deemed a waiver of any other provision, nor shall it waive any future enforcement of the same provision.
The headings and section titles in this Agreement are provided for convenience only and shall not affect the interpretation of any provision.
The following provisions shall survive termination or expiration of this Agreement, regardless of the reason for termination:
  • Fees and payment obligations
  • Indemnification obligations
  • Limitations of liability and warranty disclaimers
  • Intellectual property rights and ownership provisions
  • Confidentiality agreements, if applicable
  • Any other provisions that, by their nature, should survive termination
There are no third-party beneficiaries to this Agreement. This includes, but is not limited to, insurers, resellers, or end customers of resellers.
Customer may not transfer or assign this Agreement without prior written consent from Host Craze. Any attempted assignment without consent shall be considered null and void. Host Craze reserves the right to approve or deny assignments based on the assignee’s compliance with Host Craze’s credit and business requirements.
Host Craze reserves the right to assign or transfer this Agreement, in whole or in part, at its sole discretion. Such assignment shall not relieve Host Craze of its contractual obligations.
This Agreement, along with any associated Orders, Acceptable Use Policy (AUP), and Privacy Policy, constitutes the entire and exclusive agreement between the parties. It supersedes all prior negotiations, discussions, agreements, and understandings, whether written or oral.

Copyright Files


All files stored on Host Craze’s servers must be legally owned by the Customer and must be accompanied by a valid license and/or proof of copyright ownership. Customers are solely responsible for ensuring that all uploaded content complies with intellectual property laws, including but not limited to the U.S. Digital Millennium Copyright Act (DMCA) and other applicable international copyright laws.

Prohibited content includes, but is not limited to, the following unauthorized or unlicensed materials:
  • Music files (e.g., MP3, MID, MIDI) without proper licensing
  • Video files (e.g., AVI, MPG, MPEG, MOV, MP4) containing copyrighted material
  • Software executables (e.g., EXE, ISO) that are pirated or unlicensed
  • Cracked or illegally distributed software, key generators, or serial numbers
  • Unauthorized copies of books, magazines, PDFs, or other digital media
  • Any file that infringes on trademarks, copyrights, patents, or other intellectual property rights
Host Craze actively monitors and enforces copyright compliance. If any unlicensed or illegal content is discovered within a customer’s account, the following actions may be taken without prior notice:
  • Immediate removal or deletion of the infringing files
  • Suspension or termination of hosting services
  • Notification to the copyright holder or legal authorities, if required
  • Permanent banning of repeat offenders from Host Craze’s services
Customers are solely responsible for the content they upload and should conduct regular audits to ensure compliance. Copyright violations may result in legal action, including potential lawsuits and financial penalties. Host Craze assumes no liability for any unauthorized content uploaded by Customers.

Cancellation of Service


Host Craze reserves the right to cancel or terminate any service at any time, with or without prior notice, at its sole discretion. In cases where Host Craze elects to cancel a service for reasons unrelated to policy violations, any prepaid fees will be prorated and refunded accordingly.

However, if a service is terminated due to a violation of Host Craze’s policies, including but not limited to the Terms of Service (TOS) or Acceptable Use Policy (AUP), YOU acknowledge that no refunds, credits, or reimbursements will be issued, and YOU may be held financially responsible for any additional costs, damages, or legal fees incurred as a result of the violation.
In the event of early termination initiated by YOU, refunds are not provided for unused portions of prepaid services, except where expressly stated in a separate agreement. YOU remain responsible for all outstanding balances and must ensure that all due payments are settled before service cancellation is finalized.

Promotional Rates & Special Offers


Host Craze may, at its sole discretion, offer promotional rates, discounts, or special offers on its services. These promotions may be time-limited and subject to specific eligibility requirements. Any promotional offer provided by Host Craze is non-transferable and cannot be combined with other promotions, discounts, or special pricing unless explicitly stated otherwise.

Customers who sign up under a promotional rate or special offer agree that the terms and conditions of the promotion shall apply in addition to this Agreement. In the event of a conflict between a promotion’s terms and this Agreement, the promotion’s specific terms shall govern for the duration of the promotion.
Promotional pricing applies only to the initial term of the purchased service. Upon renewal, standard pricing will apply unless otherwise specified in the promotional terms. Host Craze reserves the right to modify, discontinue, or revoke any promotional offer at any time without prior notice.
Certain promotional offers may include a free or discounted domain name as part of the service package. In such cases, the cost of the domain registration is covered by the first month’s payment. However, promotional domain registrations are non-refundable and are not eligible for Host Craze’s standard 30-day money-back guarantee.
If a customer cancels a service that included a free domain name before the minimum required period (if applicable), the standard domain registration fee may be deducted from any applicable refund or may be required to be paid before releasing the domain to the customer.
By participating in any promotional offer, the Customer acknowledges and agrees to these terms. Promotional offers do not apply to past purchases, and any attempt to retroactively claim a promotional rate will not be honored.

Intellectual Property Rights

Material accessible to you through Host Craze‘s services may be subject to protection under the United States or other copyright laws, or laws protecting trademarks, trade secrets and proprietary information. Except when expressly permitted by the owner of such rights, YOU must not use Host Craze or its servers and network in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material that you access or receive through the Host Craze network. If YOU use a domain name in connection with Host Craze or similar service, YOU must not use that domain name in violation of any trademark, service mark, or similar rights of any third party.

Network Security


Customers are strictly prohibited from engaging in any activity that compromises the security, integrity, or availability of Host Craze’s network, servers, or infrastructure. Any attempt to circumvent authentication, exploit vulnerabilities, or interfere with network operations is considered a serious violation of this Agreement and may result in immediate service termination, legal action, and potential criminal liability.

Prohibited activities under this policy include, but are not limited to, the following:
  • Unauthorized Access: Attempting to access data, servers, or accounts without explicit authorization.
  • Hacking & Exploitation: Engaging in activities such as password cracking, security scanning, or exploiting system vulnerabilities.
  • Denial-of-Service (DoS) Attacks: Intentionally overloading, disrupting, or crashing a server, network, or service.
  • Malicious Software: Distributing viruses, worms, Trojan horses, ransomware, or any other malicious code.
  • Port Scanning & Network Probing: Attempting to identify or exploit weaknesses in systems through unauthorized scanning or probing.
  • Evasion of Security Measures: Bypassing or disabling firewalls, intrusion detection systems (IDS), or anti-DDoS protection mechanisms.
  • Email & Message Bombing: Flooding a network, server, or inbox with excessive messages to degrade service performance.
  • Botnets & Automation Abuse: Hosting, controlling, or participating in a botnet or other automated malicious activity.
Host Craze actively monitors and enforces security compliance. If any suspicious or malicious activity is detected, Host Craze reserves the right to take immediate enforcement action, including but not limited to:
  • Suspension or termination of the offending account or service.
  • Reporting the violation to law enforcement authorities and regulatory agencies.
  • Cooperating with criminal investigations and cybersecurity agencies.
  • Assessing financial penalties for damages caused by network abuse.
Users who engage in unauthorized access, hacking, or other security violations may be subject to criminal or civil liability under applicable laws, including but not limited to the Computer Fraud and Abuse Act (CFAA), the Cybersecurity Information Sharing Act (CISA), and other international cybersecurity regulations.
Host Craze will fully cooperate with law enforcement agencies and cybercrime investigators in cases of security breaches, cyberattacks, or illegal online activity originating from its network. Customers are responsible for ensuring the security of their own accounts and must use strong passwords, enable multi-factor authentication (MFA), and regularly update security settings to prevent unauthorized access.

Electronic Commerce


Customers who operate online stores, e-commerce platforms, or digital marketplaces using Host Craze’s services are solely responsible for the development, operation, security, and maintenance of their e-commerce presence. Host Craze does not provide legal, tax, or operational support for customer-run e-commerce businesses.

Customers must ensure that all products, content, and materials hosted or displayed on their online store comply with all applicable laws and do not infringe upon the rights of third parties. This includes, but is not limited to:
  • Ensuring accuracy and appropriateness of product descriptions, pricing, and related materials.
  • Guaranteeing that all content does not violate copyright, trademark, or intellectual property laws.
  • Ensuring all published materials are not defamatory, fraudulent, misleading, or otherwise illegal.
  • Calculating, applying, and collecting appropriate sales tax, VAT, or other applicable fees.
  • Properly handling and processing customer orders, refunds, returns, and customer service inquiries.
Customers are fully responsible for the security of payment data and any sensitive customer information collected through their website. If Customer collects, stores, or processes payment information, the following obligations apply:
  • Customer must comply with Payment Card Industry Data Security Standard (PCI DSS) requirements for handling credit card transactions.
  • Customer must implement secure payment processing solutions, such as SSL encryption and tokenization.
  • Customer must ensure that customer financial data is not stored in plaintext or unencrypted databases.
  • Customer must follow all applicable data protection laws, including but not limited to the U.S. Gramm-Leach-Bliley Act (GLBA), GDPR, and any jurisdiction-specific e-commerce regulations.
  • Customer must provide clear privacy policies and terms of service to users, outlining how their data is handled and protected.
Host Craze is not liable for any financial loss, security breaches, fraudulent transactions, or disputes arising from the Customer’s e-commerce activities. Any data breaches, unauthorized access, or regulatory non-compliance related to the Customer’s e-commerce operations are solely the responsibility of the Customer.
By using Host Craze’s hosting services for e-commerce purposes, Customer acknowledges that all transactions, compliance obligations, and legal liabilities associated with their online business are their sole responsibility. Host Craze does not provide tax, legal, or financial advice and strongly recommends that customers consult with qualified professionals to ensure their compliance with e-commerce laws and best practices.

Static & Dynamic Content Caching


By utilizing Host Craze’s hosting services, YOU expressly grant Host Craze the right to use content caching technologies to enhance performance, optimize load speeds, and improve resource efficiency. This includes the ability to store, duplicate, and distribute cached copies of YOUR website content across various servers, data centers, and content delivery networks (CDNs).

YOU further acknowledge and agree that:
  • Host Craze is authorized to cache the entirety of YOUR website, including content provided by third parties and hosted on Host Craze’s infrastructure.
  • Caching does not constitute an infringement of YOUR intellectual property rights or any third party’s intellectual property rights.
  • Host Craze is not responsible for outdated, temporarily stored, or improperly cached content, nor for data inconsistencies resulting from caching mechanisms.
  • YOU remain solely responsible for ensuring that all cached content complies with applicable intellectual property laws and that no copyrighted or proprietary materials are improperly stored or distributed via caching services.
If YOU request the removal of specific cached content, Host Craze will make reasonable efforts to clear such content from its caching systems; however, YOU acknowledge that complete removal across global caching layers cannot be guaranteed due to third-party network propagation.

IP Address Ownership


All Internet Protocol (IP) addresses assigned to YOU by Host Craze remain the sole property of Host Craze and its upstream providers. YOU do not retain ownership rights over any assigned IP addresses and may not transfer, resell, or claim ownership of such addresses.

Host Craze reserves the exclusive right to manage, allocate, reassign, and reclaim any and all IP addresses at its sole discretion, including but not limited to cases of:
  • Service terminations, account cancellations, or non-payment.
  • Reallocation for network optimization, server upgrades, or compliance with internet governance policies.
  • Violations of Host Craze’s Acceptable Use Policy (AUP), including abuse of IP addresses for spamming, illegal activities, or cyberattacks.
  • Compliance with regulatory requirements, government directives, or law enforcement investigations.
While Host Craze will make reasonable efforts to maintain consistent IP assignments, YOU acknowledge that IP addresses may be reassigned, rotated, or changed at any time without prior notice, particularly in cases of server migrations, network restructuring, or provider changes.
YOU must not engage in IP address misuse, including but not limited to IP spoofing, unauthorized subnet usage, or any practice that violates regional IP allocation policies established by ARIN, RIPE, APNIC, or other governing bodies.

Domain Name Registration


By registering a domain name through Host Craze, YOU agree to pay all applicable fees as set forth in the Host Craze pricing schedule before the domain registration becomes effective. These fees apply to both initial registrations and subsequent renewals. All domain registration fees are non-refundable, in whole or in part, even if YOUR domain is later suspended, canceled, transferred, or not utilized before the end of the registration term.

Host Craze reserves the right to adjust fees, surcharges, renewal costs, or implement new pricing at its sole discretion. A domain will not be registered until Host Craze receives full payment and sends confirmation to the email address provided in YOUR registration application. In the event of a chargeback, reversal, or dispute initiated through a payment provider, YOU acknowledge and agree that ownership of the domain will immediately transfer to Host Craze, and Host Craze reserves the right to retain, resell, or delete the domain. Reinstatement is solely at Host Craze’s discretion and will require full payment of the initial registration fee, renewal costs, and applicable reinstatement fees.
Transferring a Domain to Host Craze
If YOU request to transfer a domain registration to Host Craze from another registrar, YOU agree to pay the transfer fee prior to the initiation of the transfer. Domain transfers may fail under the following circumstances, including but not limited to:
  • Failure of the Registered Name Holder or Administrative Contact to approve the transfer request.
  • The domain is in Registrar Lock Status and has not been unlocked at the previous registrar.
  • The domain is subject to ICANN transfer restrictions, such as being within the first 60 days of initial registration or within 60 days of a prior registrar transfer.
Host Craze reserves the right to modify transfer fees, surcharges, and other costs at any time. A domain transfer will not be completed unless full payment is received and a confirmation email has been issued. If a chargeback or dispute is filed after a transfer, the domain reverts to Host Craze’s ownership, and reinstatement is solely at Host Craze’s discretion.
Transferring a Domain Away from Host Craze
If YOU wish to transfer a domain from Host Craze to another registrar, YOU acknowledge that Host Craze may deny transfer requests for any of the following reasons, including but not limited to:
  • No response from the Registered Name Holder or Administrative Contact to confirm the transfer.
  • The domain is in Registrar Lock Status, and no authorized request has been made to unlock it.
  • The domain is within 60 days of initial registration or a prior transfer, per ICANN restrictions.
  • The domain is expired or within the redemption or restoration period.
  • Outstanding fees are owed on the domain name or associated services.
YOU acknowledge that the success or failure of a domain transfer is solely YOUR responsibility. Host Craze shall not be liable for any failed, delayed, or incomplete transfers due to third-party registrar policies, registry restrictions, or technical issues beyond our control.
Non-Refundable Domain Registrations
All domain registration fees are final and non-refundable, regardless of usage, cancellations, spelling errors, or customer preference. Domains cannot be canceled or modified once registered, except where permitted by ICANN policies or registry-specific rules.
It is the customer’s responsibility to verify domain spelling, extension selection (.com, .net, .org, etc.), and availability before purchase. Host Craze is not responsible for domain registration errors caused by incorrect customer input.

Lawful Purpose

Host Craze reserves the right to refuse service to anyone. YOU may only use Host Craze server for lawful purposes and our services may not be used for illegal purposes or in support of illegal activities. We reserve the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing. If anything is not legal in the United States of America, it is not permitted to reside on our servers. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes but not limiting material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: ‘Pirated Warez’, OGG, AVI, MPEG, ISO, ‘Hacker programs or archives’, ‘Copyrighted Digital Movie Copies (DIVX)’ and ‘Unlicensed MP3’. The designation of any materials as such described above is left entirely to the discretion of Host Craze management.
If illegal content or usage is found, the account will be suspended and/or terminated. YOU agree that Host Craze may disclose any and all YOUR information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification.
Regardless of the place of signing this agreement, YOU agree that for purposes of venue this contract is entered in Fremont, California, and any dispute will be litigated or arbitrated in Fremont, California. Defendants further waive all objections to venue and acknowledge that venue in any such litigation will be held in Fremont courts. IN NO EVENT SHALL Host Craze‘S MAXIMUM LIABILITY EXCEED FIVE HUNDRED ($500.00) DOLLARS.

We encourage YOU to carefully review our Privacy Policy, which provides detailed information about how YOUR personal data is collected, used, shared, and safeguarded. By continuing to use our services, YOU confirm that YOU have read, understood, and agreed to our Privacy Policy and acknowledge YOUR rights regarding data access, rectification, and deletion.
